Understanding Roadside Cannabis Testing Michigan

After a short pilot program for roadside drug testing (only 92 tests done) Michigan Drug Recognition Experts will now utilize their new drug-detecting device on roadside stops.

The DREs now have a device that is similar to an alcohol breathalyzer used in OWI (DUI) cases. This new device supposedly tests for amphetamines, benzodiazepines, cannabis (delta 9 THC), cocaine, methamphetamines, and opiates.

What’s more concerning is these DRE’s are not trained enough on this brand new device only having to complete 72 hours of classroom training and 40 hours of field training.

Fortunately, using results from this device cannot be used on their own as evidence. They are similar to the admission to roadside breathalyzers.

This device is NOT accurate and could lead to your arrest. If you aren’t under arrest, refuse the test.

Another cannabis lawyer in Michigan weighed in: Attorney Michael Komorn of Komorn Law in Farmington Hills questioned the testing pilot program, saying it is based on “junk science” and the validity of the testing device has not been proven.” “That is what’s missing here,” Komorn said. “There’s no consensus anywhere that the machine stands as a reliable method of testing.”
